1. About Dayman Coaching
Dayman Coaching is operated by two self-employed personal trainers:

Services include in-person personal training, hybrid coaching, online coaching, training programmes, nutritional guidance, and habit tracking.
By purchasing or participating in any Dayman Coaching service, you agree to these Terms & Conditions.
2. Eligibility & Health Declaration
By engaging in coaching services, you confirm that:

You are at least 18 years of age, or have parental/guardian consent

You are physically able to participate in exercise

You have disclosed all relevant medical conditions, injuries, or medications
-
You agree to inform us promptly of any changes to your health, medical condition, injuries, or medications during the course of coaching.
If required, we may ask for medical clearance from a qualified healthcare professional before commencing or continuing training.
Failure to disclose relevant medical information may result in services being paused or terminated for safety reasons.
Clients may be required to complete a health questionnaire or liability waiver prior to commencing services.
3. Coaching Scope & Disclaimer
Dayman Coaching provides:

Fitness coaching

General nutrition guidance
We do not provide medical advice, diagnose conditions, or prescribe treatment. Nutritional advice is not a substitute for medical or dietetic care.
You acknowledge that participation in physical exercise, whether in person or online, carries inherent risks. You choose to participate voluntarily and accept responsibility for your own health, safety, and wellbeing during and outside of coaching sessions.
4. Client Responsibilities
You agree to:

Follow instructions provided during coaching sessions

Train within your ability and notify us of discomfort or pain

Maintain appropriate behaviour during sessions and communication

Use coaching advice responsibly

You agree to stop exercising and notify us as soon as reasonably possible if you experience pain, dizziness, or injury during or following training.
You are responsible for completing appropriate warm-up and cool-down activities and for modifying or stopping exercises if you experience pain, discomfort, or fatigue.
We reserve the right to refuse or discontinue services if behaviour is unsafe, inappropriate, or abusive.
5. Payments & Pricing

All services must be paid for in advance unless otherwise agreed

Prices are confirmed prior to purchase

Payments are non-refundable once services have commenced
Dayman Coaching reserves the right to change pricing with reasonable notice.
6. Cancellations & Missed Sessions
In-Person Sessions
-
A minimum of 24 hours’ notice is required to cancel or reschedule
-
Sessions cancelled with less than 24 hours’ notice will be forfeited
-
Missed sessions without notice will be charged in full
Online Coaching
-
Online coaching operates on a rolling or fixed-term basis
-
Early termination does not entitle you to a refund
7. Pausing Services
Pauses due to illness, injury, or personal circumstances may be considered at our discretion.
Medical evidence may be requested for extended pauses.
8. Online Coaching & App Use
Online coaching services may be delivered via third-party platforms, including the Kahunas app. You are responsible for maintaining access to the required technology and internet services.
Online coaching is provided on a programme-only basis. Exercises completed outside of in-person sessions are performed independently and without direct supervision. Programme-only online coaching does not include real-time monitoring, supervision, or emergency support during exercise.
You are responsible for ensuring that your training environment is safe, appropriate, and free from hazards, and that any equipment used is suitable, properly maintained, and used correctly.
We are not responsible for service disruptions caused by third-party platforms or technical issues outside our control.
9. Data Protection & Privacy
We process personal data in accordance with UK GDPR and the Data Protection Act 2018.

10. Results Disclaimer
Results from coaching vary between individuals and depend on multiple factors including consistency, lifestyle, nutrition, and genetics.
We do not guarantee specific outcomes, including weight loss, muscle gain, or performance improvements.
11. Intellectual Property
All training programmes, materials, content, and resources provided by Dayman Coaching are for personal use only.
They may not be copied, shared, resold, or distributed without written permission.
12. Limitation of Liability
To the fullest extent permitted by law, Dayman Coaching accepts no liability for any injury, illness, loss, or damage sustained as a result of participating in coaching services or following training programmes, whether in person or online, except where such loss or injury is caused by our negligence or where liability cannot be excluded under UK law.
We are not responsible for injuries resulting from failure to follow coaching guidance, misuse of equipment, or training beyond advised limits.
When training at third-party venues or client premises, Dayman Coaching is not responsible for the condition or maintenance of equipment or facilities not owned or controlled by us.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence.
13. Termination of Services
We reserve the right to terminate services immediately if:

Information provided is false or misleading

Payment obligations are not met

Client behaviour is unsafe or inappropriate
No refunds will be issued where termination is due to client breach.
14. Changes to These Terms
We may update these Terms & Conditions from time to time.
The most current version will always be available on our website. Continued use of our services indicates acceptance of the updated terms.
15. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Kahunas App and Third-Party Processing
We use the Kahunas app to deliver coaching services, communication, and progress tracking.
Kahunas acts as a data processor on our behalf. While data is stored on Kahunas’ servers, Dayman Coaching remains responsible as the Data Controller.
